The use of services from Christian Music DJ constitutes agreement to these terms (known here as the “Terms of Service” or “TOS”). You, the customer, or the person, or entity using these services are known here as the “customer” or “you”.
Accounts and Listings
All individual accounts, business accounts, and any ads or listings must be truthful and not deceptive. You agree not to represent another party or business without the authorization and consent of that party or business. You agree not to spam or harass any other persons or businesses or use our service to do so. Features on this website may allow others to report abusive behavior. We reserve the right to suspend or terminate any account whether personal or business for violation of our policy or any of our guidelines. We may also cancel your account due to changes in our service or at any time. We will make reasonable effort to contact you on major changes that may affect you. You agree to keep your contact information correct and updated in your account. You also agree to respond in a timely manner (sooner than, but within 48 hours) to emails or other secondary methods of contact. We may contact you regarding important issues related to your account(s). These issues include but are not limited to potential policy violations, security issues, privacy, abuse issues, and payments and refunds. You agree that a lack of response from you does not impede our ability to make a decision and take action that may affect you and/or your use of this service.
Ads
If you hide or delete your ad it’s place will be replaced in queue or rotation with another ad (for Top Ads it will be replaced by the next Top Ad in queue in order of purchase and activation date of the ad). If your ad was hidden and you unhide it, it will return to its position before the ads that were purchased and activated subsequent to it until you hide your ad again or it expires. All ads expire 30 days from the date of purchase. All ads except Top Ads auto-renew. We may offer you an option to keep your ad position and renew the ad by billing you shortly before it is due to expire. You can stop the ad from showing by hiding it or deleting it. Deleting an ad will remove it from the ad location on the website and you will no longer have access to it.
Adding an an ad item to your cart and paying for it is considered to be a purchase, whether or not you create the content for the ad or make it active on the website.
Not all Top Ads are stationary. The third postion Top Ad is not static and rotates among all other purchasers that have that position by default or choice. The top two static positions expire 30 days from the date of purchase (not by the date you activate it). Any other paid ad positions will expire 30 days after purchase. The free ads or those not paid for are subject to end at any time with or without notice. We may end a paid positional ad sooner than the 30 days with a prorated refund of the amont paid for the ad. At this time, all Top Ads are the same price regardless of position. That pricing policy can change at any time and affect any new users of the ads immediately. It also affects subsequent purchases of ads. Trial ads are not purposed to auto-renew or be renewed after their term. The term for Top Ads is 30 days as stated above.
The advantage to the purchaser of a Top Ad is to get one as soon as possible. Only the top 2 Top Ads are stationary or static. The third position rotates. Top Ads are all the same price, with the possibility for a third position ad to move up into the top 2 by way of one of the top 2 ads either being hidden or deleted. The first 2 purchasers of Top Ads in a particular industry category assume the top 2 ad positions on that page upon unhiding their ads. Any subsequent buyers of Top Ads in that industry will be able to acquire a third position Top Ad. Top Ads in the third position (vertically from the top), rotate.
You are responsible for checking your ad and business listing for inaccuracies. We cannot be responsible for any loss arising out of inaccuracies in your ad. We do not guarantee uptime or availability of your ad. Let us know if you believe there is an issue with your ad showing. You are also responsible for its content. No deceptive ads allowed. No ads or links to websites or content that is harmful, defamatory, inciting hate, or offensive material are allowed. We reserve the right to refuse, suspend, or remove any ad at any time. These ad programs are subject to change at anytime.
Orders and Payments
Orders and respective payments are confirmed on the site for your convenience. However, onscreen confirmations of payments are not an official confirmation of your payment or order. We acknowledge payments made through our cart, our third-party payment processor, and/or PayPal as unofficial so that you can have a smooth and uninterrupted use of our site – as much as possible. The Internet is not 100% reliable or secure. With that said, we reserve the right to confirm any such payments as being authentic for respective items, products, and/or services on our site. If at a later time we cannot confirm payment was made for a transaction or determine it may have involved fraud, we may immediately suspend or terminate that order and all related items, products, and/or services. We generally, will attempt to contact the involved parties to validate whether or not the transaction was actually made. Cases of potential fraud may be turned over to law enforcement.
Refunds
The general rule as far as refunds is there are no refunds. This includes purchases made through this website or through representatives of Christian Music DJ. However, we may end a paid positional ad sooner than 30 days with a prorated refund of the amont paid for the ad. Refunds are not given for deleted ads, expired ads, innacuracies in the ad, ads hidden by your account settings, and/or suspended ads for violations of our Terms of Service or any Ads Guidlines. There are no other pro-rated refunds.
Right of refusal
We reserve the right to refuse service to anyone for any reason.
Copyright and Intellectual Property
All copyrighted content belongs to its owner and any use should be with their consent otherwise consent is not given for your use. The logos and Service Marks Christian Music DJ, Christian Music Disc Jockey, and “Reach the world!”, and “Reach the world with music and more…” are copyrighted material and Service Marks of Christian Music DJ and its owner. All rights are Reserved. The copyright, audio, pictures, graphics, video content, and any other media on the pages of this website are the reserved material of Christian Music DJ, and its respective owners if other material appears.
You agree not to upload or use content here that is not your own unless you have permission or the consent of the respective owner to do so.
Indemnification
Customer agrees that it shall defend, indemnify, save and hold Christian Music DJ harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against Christian Music DJ, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Christian Music DJ against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Christian Music DJ; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from accounts or websites referred to, linked to, developed, or managed by Christian Music DJ.
Arbitration
By using any Christian Music DJ services, you agree to submit to binding arbitration. If any disputes or claims arise against Christian Music DJ or its subsidiaries, such disputes will be handled by an arbitrator of Christian Music DJ’s choice. An arbitrator from the American Arbitration Association or the National Arbitration Forum will be selected in the state of Texas. Arbitrators shall be attorneys or retired judges and shall be selected pursuant to the applicable rules. All decisions rendered by the arbitrator will be binding and final. The arbitrator’s award is final and binding on all parties. The Federal Arbitration Act, and not any state arbitration law, governs all arbitration under this Arbitration Clause. You are also responsible for any and all costs related to such arbitration.
Disclaimer
Christian Music DJ shall not be responsible for any damages your business may suffer. Christian Music DJ makes no warranties of any kind, expressed or implied for services we provide. Christian Music DJ disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by Christian Music DJ and its employees.
Disclosure to law enforcement
Christian Music DJ may disclose any subscriber information to law enforcement agencies without further consent or notification to the subscriber upon lawful request from such agencies. We reserve the right to cooperate with court orders and lawful requests from law enforcement.
Miscellaneous
You agree that your acceptance and use of Christian Music DJ’s services does not create any partnership or entitle you to any share of Christian Music DJ. This includes but is not limited to the upload, disclosure, and/or sharing of information and items in form filled content, usernames, business names, logos, media and content uploads, writings, copywrite, or any intellectual property. Any content you provide or upload remains your property or that of its respective owner who consent to its use here. You agree that you or yourself authorized by the original owner of the content allow Christian Music DJ use, access, and control of the content that is provided by you and used here. You may delete or remove any content of your own you no longer want to appear here or us to use. We provide the account, known here as “Account”, (Free Sign Up account currently initiated at www.christianmusicdj.com/signup.php) for your use if you are an individual, business entity or organization to advertise and/or interact with the site, businesses and organizations, the public, and customers looking for various service fulfillment. If you are looking for joint venture or investment opportunities in Christian Music DJ, you should first contact us directly through appropriate authorized channels. Accounts here are NOT accepted means to invest in, partner, or joint venture with Christian Music DJ. Also, Christian Music DJ, its staff, or any authorized agents are not allowed or able to accept suggestions of the nature of inventions or intellectual ideas. We do not automatically acknowledge, consent to, or imply any contractual arrangement or agreements – this includes but is not limited to royalties, commissions, or disbursements.
